Terms and Conditions for Ceylongeaway

Welcome to Ceylongeaway! These Terms and Conditions (“Terms”) govern your use of the Ceylongeaway website, mobile applications, and all related services (collectively, the “Website”). By accessing or using our Website, you agree to be bound by these Terms, our Privacy Policy, and all other policies referenced herein. If you do not agree to these Terms, please do not use our Website.

1. Definitions

  • “Ceylongeaway,” “we,” “us,” “our”: Refers to the online travel booking platform, Ceylongeaway.

  • “User,” “you,” “your”: Refers to any individual accessing or using the Website.

  • “Customer”: Refers to a User who makes a booking or purchase through the Website.

  • “Services”: Refers to the online travel booking services provided by Ceylongeaway, including but not limited to, the search, comparison, and booking of flights, accommodations, tours, and other travel-related products.

  • “Supplier”: Refers to third-party providers of travel services, including but not limited to airlines, hotels, tour operators, car rental companies, and travel insurance providers.

  • “Booking”: Refers to any reservation, purchase, or transaction made by a Customer through the Website for travel services provided by a Supplier.

  • “Website”: Refers to the Ceylongeaway website, its subdomains, and any associated mobile applications or platforms.

2. Acceptance of Terms

By using the Website, you represent that you have read, understood, and agree to be bound by these Terms. If you are using the Website on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

3. Website Use

3.1 Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use this Website and make Bookings.

3.2 Accuracy of Information

You are responsible for ensuring that all information you provide to us, including your personal details, travel preferences, and payment information, is accurate, complete, and up-to-date. Ceylongeaway shall not be liable for any errors or issues arising from inaccurate or incomplete information provided by you.

3.3 Prohibited Activities

You agree not to:

  • Use the Website for any unlawful purpose or in any way that violates these Terms.

  • Make any false, fraudulent, or speculative Bookings.

  • Access, monitor, or copy any content or information from this Website using any robot, spider, scraper, or other automated means or any manual process for any purpose without our express written permission.

  • Bypass or circumvent any measures we may use to prevent or restrict access to the Website.

  • Interfere with or disrupt the operation of the Website or the servers or networks connected to the Website.

  • Transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature.

  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.

  • Collect or store personal data about other users without their express permission.

4. Booking and Payment

4.1 Role of Ceylongeaway

Ceylongeaway acts solely as an intermediary and booking agent between you and the various Suppliers. We do not own, operate, or provide the travel services ourselves. Our responsibility is limited to facilitating the Booking process and providing customer support related to your use of our platform.

4.2 Booking Confirmation

All Bookings are subject to availability and confirmation by the respective Supplier. A Booking is not confirmed until you receive a confirmation email from Ceylongeaway containing a booking reference number. It is your responsibility to review the confirmation and verify all details.

4.3 Pricing and Payment

  • Prices displayed on the Website are subject to change without prior notice.

  • All prices are quoted in Sri Lankan Rupees (LKR) unless otherwise specified.

  • Prices may exclude certain taxes, fees, and charges (e.g., airport taxes, resort fees, baggage fees) which may be payable directly to the Supplier or at the destination.

  • Full payment is typically required at the time of Booking. We accept various payment methods as indicated on the Website.

  • For security reasons, Ceylongeaway utilizes secure payment gateways and may require additional verification for certain transactions. We generally adhere to industry standards like PCI DSS for secure handling of payment data.

4.4 Cancellation, Amendments, and Refunds

  • Cancellation and amendment policies vary depending on the Supplier and the specific travel product booked. You must review the Supplier’s terms and conditions related to cancellations, amendments, and refunds before making a Booking.

  • Cancellations or amendments must be requested through Ceylongeaway’s customer support channels.

  • In addition to Supplier charges, Ceylongeaway may levy an administrative fee for cancellations or amendments.

  • Refunds, if applicable, will be processed according to the Supplier’s policy and may take time to reflect in your account. Ceylongeaway is not responsible for delays caused by banks or payment processors.

5. Travel Documents and Requirements

You are solely responsible for ensuring that you and all members of your traveling party comply with all passport, visa, health, customs, and immigration requirements of Sri Lanka and any other country you are visiting or transiting through. Ceylongeaway does not provide advice on these matters and accepts no liability for your failure to meet these requirements.

6. Disclaimer of Warranties

The Website and its content are provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of information. Ceylongeaway does not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

To the maximum extent permitted by Sri Lankan law, Ceylongeaway, its directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from or in connection with:

  • Your access to or use of, or inability to access or use, the Website.

  • Any conduct or content of any third party on the Website.

  • Any content obtained from the Website.

  • The acts, errors, omissions, representations, warranties, breaches, or negligence of any Supplier or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.

8. Indemnification

You agree to indemnify, defend, and hold harmless Ceylongeaway, its directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the Website, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.

9. Intellectual Property

All content on the Website, including text, graphics, logos, images, software, and the compilation thereof, is the property of Ceylongeaway or its content suppliers and is protected by Sri Lankan and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as generally permitted for personal, non-commercial use.

10. Privacy Policy and Data Protection

Your use of the Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, use, store, and disclose your personal information.

In accordance with Sri Lankan cyber security principles and the Personal Data Protection Act, No. 9 of 2022 (effective from 2025):

  • We implement reasonable administrative, technical, and physical safeguards to protect your personal data from unauthorized access, use, or disclosure.

  • By using the Website and providing your personal data, you consent to the collection, processing, and transfer of your data as described in our Privacy Policy and these Terms. This includes sharing necessary personal data with Suppliers to facilitate your Bookings.

  • You have rights regarding your personal data as outlined in our Privacy Policy, which may include the right to access, correct, or withdraw consent for certain data processing activities.

  • We are committed to maintaining the confidentiality, integrity, and availability of your information and protecting against cyber threats in compliance with applicable Sri Lankan laws and international best practices.

11. Links to Third-Party Websites

The Website may contain links to third-party websites or resources. These links are provided for your convenience only. Ceylongeaway has no control over the content of these external sites or resources and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

12. Modifications to Terms

Ceylongeaway reserves the right to modify or update these Terms at any time. We will notify you of any significant changes by posting the updated Terms on the Website with a new “Effective Date.” Your continued use of the Website after such modifications constitutes your acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms and your use of the Website shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Sri Lanka for the resolution of any disputes arising out of or relating to these Terms or the Website.

14. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Website shall first be attempted to be resolved amicably through good faith negotiations. If a resolution cannot be reached, the parties agree to submit the dispute to the exclusive jurisdiction of the courts of Sri Lanka.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Ceylongeaway regarding your use of the Website and supersede all prior or contemporaneous understandings and agreements, whether written or oral.
